Sick Pay: i was off work due to sickness for four days and only got Statutory Sick Pay?
|
I was off work due to sickness for four days, when my pay slip came in i learnt i had only been given Statutory Sick Pay which amounted to £15 for the whole four days... i have worked here full time for a year and a half, and i work using CAD in an office... Is this correct? i thought i should be paid in full for such a short time off, its the only days off i have had since joining. i need to learn what is correct before i start complaining.

Speak to your HR dept.
Companies are not obliged to give you full pay when you are off sick and it will depend on the companies policies and your terms and conditions.

Your company does not have to pay you sick pay, but any decent employer would. You do not receive statutory sick pay for the first 3 days of any absence, so if you were off for 4 days you would only get paid for 1 day. The rate is £76 per week, so £15 is correct. You need to find a job with an employer that pays sick pay. |

You need to check the written statement of your terms of employment or your contract. But an employer is well within their rights to only pay you SMP, unless the terms of your employment state otherwise. |

SSP is not payable for the first 3 days of an illness. The £15 is just for the 4th day you were off.
Your contract of employment should state when and how much you are paid if off sick. There is no compulsion for an employer to pay any more than SSP, which they reclaim from HMRC, some do as an attraction to work for them.
Whilst it is not pleasent so long as you do not have a contract of some sort with them that says they will pay you then they do not have to. |

The weekly rate of ssp is £76 so it does seem a little low.

different companies have different policies as to what they pay for sick pay some dont pay anything at all. u should refer to yr contract of employment to find out if what u have been paid is correct. |

Firstly as suggested the amount paid to you is incorrect (or so it would seem). Secondly the next thing you MUST do before going any further is carefully read your contract of employment which you will have signed so therefore would know in advance what SSP arrangements would be in place).
On the assumption that the contract states you will be paid in full for the first (however many) days you must then immediately point out to payroll department they have made a mistake. You should also ask why you have only received what you have, they will explain it with the knowledge appertaining to your personnel file, and we can at this stage make a calculated guess.
You may also want to read the section on self-certification and what you should do when you are going to be absent (phoning in etc) to be certain you have correctly complied with eth terms of contract.
On the basis you actually don't have a written contract then you have a case to claim sick pay in full (in the absence of being informed otherwise) also ask why you have not been presented with a CoE! Whilst it is accepted that a CoE may be a verbal one you will require some documentation this may be via an 'employee handbook' or a simple job title memorandum when you started.
Where any person works for another for reward there is a contractual relationship. The lack of written evidence in the form of a written contract does not nullify that contractual relationship. There is no requirement for a contract to be in writing; however within two months of starting employment, the employee must be issued with a written statement of the terms and conditions under which they are employed, which I refer to above.
Sickness notification and payment; is the section you should be looking for in either the original offer letter/job title, or handbook or indeed the contract, which as I have indicated need not be a fully documented written contract per se.
Sorry to have waffled on a bit but I had give a bit of a 'scatter gun' approach as I don't know what you have in place in terms of any written agreement.
Good luck by-the-way, I sincerely hope you get this one resolved.
