Sick leave to return with less hours?

I was out sick for 2 weeks with a doctors note. My boss now wants to cut my hours due to my absence. Is this legal? I live in Mo

The doctors note prevents the employer from sacking a person for availing long spell of leave. The payment for the period of leave is based on the employment contract and insurance facility, if any !!

Unless you are considered disabled and covered by Federal law, your boss can reduce your hours whenever he/she wants. A absence due to sickness, with a doctors note or not, is still an absence and in most places of employment, counts against you. Any absence effects your employer and your co-workers regardless of why you were absent. Most employers try to be understanding, but let's be realistic too...the bottom line is, employers have a business to run, and while you were gone, maybe they hired someone to take up the slack of you being gone - which would reduce your hours when you came back. Or maybe they just don't want to take the chance that you're going to be calling off more. They're covering themselves. That's business and its perfectly legal (with the exception of federally covered disabilities).

This sitution needs to be better defined in order to give a good response.

Was the illness a covered illness? Just because you have a doctor's note does not mean the absences were excused. Did you have sick leave or disability leave?

Did your boss tell you that the reduced hours were do to you missing the time from being sick. If so, was it in lieu of termination... really need to know if it was a covered absence.

Has everyone's hours been reduced or everyone in a certain department because of reduced orders, part shortages, etc?

If your absences were covered and your boss is punishing you for not reporting to work, I would suggest that you contact your Human Resources department and explain the situation to them. If this is not the case, I need more information.

A doctor's note guarantees nothing and has no legal enforcement.

UNLESS, you were out on FMLA (serious medical condition, had been employed for a year, more than 50 employees at your location). FMLA protects your postition within a company. Barring that, your employer is absolutely allowed to cut the hours of an employee he can't depend upon to be at work.

my wife left job due to cancer in nov 2010. she is now in remittion and called her boss on june 22 2011 to get her job back with a doctors note saying she can return but with restrictions. company only will give less hours. can she collect?
