What does this mean in a courtroom?
There is something like a fifth commitment right...?
I don't get what this would mean...If someone decides not to answer a question, does it give away something..?

well basically one has the right to remain silent... but it makes you look a bit guilty doesn't it?!
if you're asked "where were you the night of the incident" and you refused to answer, there will be poeple that immediately assume you were at the scene of the crime and are not answering because you don't want to admit to it, but don't want to lie either. so the term "silence speaks volumes" refers to the assumptions people will make if someone remains silent, especially if they don't answer any questions properly. They make themselves look guilty and as if they have something to hide. |

A fifth commitment right?
I suspect you mean a fifth AMENDMENT right - which reads:
No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.
A person doens't have to be a witness or testify against themselves, or answer a question that would incriminate them. Silence could indicate guilt, which is why it the saying "Silence speaks volumes". |
