Texas unemployment benefits?

My unemployment benefits have been appealed by my former employer. It seems that after the original benefits were granted, they are on a hunt for misconduct. Are they allowed by law to come up with misconduct after the fact? There was no misconduct stated in the original questioning, but they are coming up with debateable misconduct for an appeal. I thought we left on relatively good terms and I mentioned that I had an emergency fund of $120,000 dollars. Can being frugal, and making wise investment hurt me in anyway? Any help would be appreciated!

in unemployment the assumption is you qualify and it is up to the employer to prove otherwise. your finances are of no relevance in this process. often applicants are approved before the employer ever gets to respond to a claim and most claims are appealed by either the employer or employee. if there was no misconduct then the appeal will be denied. if they have proof and win the appeal then you can be required to pay back what benefits you received.

I live in Texas. The unemployment office always sides with the employer, not the employee. When they file the appeal, the state will move on it very rapidly. From my past experience you'll be lucky if you get a chance to contest it. I don't really remember what the rules are but I think the state can deny benefits if you have a stash of money like that $120k. I was once let go due to lack of education to continue the job. The employer lied to the unemployment office about my termination reason....used the reason they fired the IT Mgr a month before. I tried to file an appeal but the unemployment office would never accept anything I had to say. I even sent in a copy of the signed termination notice given to me by my employer. When the decision came it was in the employer's favor.

Yes, they can appeal your claim, but the chances are that they will probable lose again. Your emergency fund has nothing to do with your unemployment benefits. You will have the opportunity to read their claim of misconduct and make preparations for your next hearing in plenty of time. One question comes to mind is to ask them during your hearing why are they just now entering this information and are there any discipline letters that support their statements.
