My older sister was an LPN, had been for 7 years. She committed suicide with an overdose of Ambien in May, leaving 2 small kids behind. She left a note , stating her reasons. Her main reason was regarding a fromer employer, a doctor she had worked for in 2003. His wife falsely accused her of having an affair w/ the boss. The boss did not defend her.,His wife later called my sister and apologized, admitting that her husband had had numerous affairs and asked that my sister keep this in confidence, which she did. This guy was held in very high esteem in our commuinity. He began to treat my sister very badly, covering all his bases to fire her, which he did, several mos later for insubordintaion. My sister never fought back, which was her problem. She thought it was moot and that she didn't have a chance against him. She relocated but this issue followed her. The doctor and his wife gave her bad references when employers would call. She removed them from her resume' and finally gained employment but was terminated for reasons unknown to her. We were told by an employer that the doctor's wife called the facility and tried to discredit her and strongly advised that my sister not be hired or he would pull his privileges.. She was a good nurse, I worked with her and all her co workers could verify that she was reliable, dependable,etc.This rollercoaster went on for her for several yrs and really shook her . She was never the same and did not feel she could support her kids because she was always so worried about this coming back up to haunt her. She tried being honest but few employers in the medical community wanted to be involved in it. I am wondering if we can file a wrongful death suit against this man. I know this is wrong, but Iwant to tear his face off or run a full page ad revealing all the dirt on him that my sister wouldn't. She was a lovely, sensitive person who felt things easily and she never got over this. How could she when it followed her ? Do we have grounds for a civil suit ?

Smelly*** I really like your idea about scanning it to the web. I may do that. She had never had problems befor securing a job and was a good person. He destroyed her and made it impossible for her to get a job. The odd thing is, he is very well respected and keep up this fascade that he has a perfect marriage and he oozes pseudo charm. He even had the nerve to call us and go on and on about what a lovely person my sis was. We didn't have the note then, the police took it and we didn't get it back until after the medical examiner deemed her deatha suicide or I would have told him about the note blaming him froom barring her from school, jobs,etc.

let it go!
you don't have any kind of case for a civil suit and don't do something STUPID (as it was suggested) like posting the note on the internet.
you make accusations you can not prove with malicious intent and you are looking at a definite civil suit and possible criminal liabilities.
please God for the kids let it go and move on.
this will only hurt the family, you and the children to continue down this road of blame. seek counseling there are numerous groups for survivors but whatever you decide move on. |

Condolences to you, and to her children. This situation really stinks. But unless you can prove all of this, you most likely don't have cause for any legal action - and even if you can prove it, might not be in a real strong position, since ultimately your sister made the decision to end her life, and proving that the doc and his wife caused it would likely be impossible.

First of all, condolences to you, and to her children.
You have no ground for a civil suit based on wrongful termination. But you have grounds for a civil suit on wrongful death.
Although I am not a attorney, but basically wrongful death must include several elements in order to have a good case, such as condition of the deceased (Is she forced to death? Is she have any condition that led to her own death? Any factors that accelerate the problem? )
In your case, the doctor's family may have a big factor on that. For instance, your sister never has a mental problem. Because of this incident, she committed suicide. Did the doctor's family contribute a factor causing her death?
Also, if the doctor's family has encouraged her commit suicide. It may consider second degree murder or involuntary manslaughter, which depends on the state you are in.
I am strongly recommended you not to ask more question here because you really talk to an attorney. Furthermore, preserve all your sister belonging in order to gather more information as possible.

if you look around, you will probably be able to find some scum bag lawyer to file a suit for you. but you are not going to get anywhere. you have nothing but heresay to go on. you sister is not around to counter any arguments the defense mounts. i can't see how you will possibly get anywhere with this.
but it sounds pretty crappy, and those people sound rotten.
you could always scan your sister's note and post it on the web or send copies to people.
but all of these ideas are pretty low. do you want to stoop to their level? |
