Time card records being withheld from me... is this legal?

I use a time clock punch system to clock in and out everyday (it's the kind that uses your hand for identifying you) so there isn't anything for me to copy at the end of a work week.
During my last 2 pay periods I have felt that I haven't been getting paid correctly, I'm always short a couple of hours, so I started logging them. Last pay period, I should have been paid for 80 hours and was only paid 76! I asked my HR manager for a copy of my records and she said "The reports I run on ADP are designed for management use. "
How is this legal?? Is it?
Are there any Labor Laws I can look into to make her give them to me? I work in Woodland Hills, CA Additional Details I should mention, I'm not trying to et paid for unapproved overtime. I just want to get paid for the 80 hours that I WORKED... and am required to work.

Yours is a legitimate request. Go to your boss, then go back to HR, and only if they fail to comply, then do you go to the authorities -- that would be the Labor Board. However, you're dealing with bureaucrats so don't expect instant results. Also, you could well be fired for stirring things up. Not to say you just put up with this if you feel you've been wronged.
I once worked for a firm that knocked unauthorized overtime hours off the weekly report before calculating payroll. obviously overtime needs to be approved by supervisors BEFOREHAND. however, I also suspect that many of those hours were legit, and that the company was getting away with murder. In any case, the workers were largely undocumented so no-one said anything. |

California has very strict labor laws.
Go to your state's website.
Does your employer deduct for lunch or breaks?
You dont need a copy of the report, just ask the HR person how it was calculated. Ask in writing, like an email, so that you have a paper trail. |

Your HR person is a moron (sorry.) You are entitled to view your own time records. You can file a claim with the dept of labor (www.dol.gov) if you feel you have been underpaid.

That is BS, I have managed an ADP payroll system. Tell her the situation, that may help you. It seems like you are trying to be mystery man. Make it obvious you think you are not getting paid the correct amount of hours, if she will not help -go above her. It sounds to me like you are being the hard head, I could be wrong.
Not to mention, your pay stub should have that information with regards to hours worked, taxes deducted, etc.. |

they can get the time cards
any company that is being honest would have tried to resolve this quickly
but since they have refused they know that they are cheating you file a complaint

Talk with your boss. It is probably an oversight by you, HR or your boss. They may be docking you 1/2 or an hour each day for lunch every day no matter what. Check into things like that since it is stupid for someone to just dock some of your hours to save money. People get fired quickly for that.
Something is not being counted correctly, have HR explain all the time clock rules to you and see if you're missing something. If not, their payroll system may be messing up and you are owed every minute you work. ask your boss to get you work hours printed out for you and compare with your records.

you can keep a record of exactly when you "punch" in and out. if you are short call the labor relations office near you. look in government pages of your local yellow book. you may also check to see if they are in the local chamber of commerce and report to them. you can also write to the better business bureau. |

Lots of companies set the clocks to read off of the schedule. If you are scheduled to work 37.5 or 38 or whatever hours per week then that is all it will show regardless of how many hours you put on the clock. You may want to check on that. That is not illegal if the company has written policies on how and what they will pay you. It is up to you to read up on the policies. It is surprising how many employees don't bother to read the policy and then complain about their time.
She should still be able to provide you a report of your time when requested. That is violating Federal and State laws. |
