UK: Can insulin dependant diabetics operate FLT's?

Does anyone know the current legislation or where I could find it out?
Someone I know been insulin dependant diabetic for 20 years & been employed by Tesco's Distribution for 18 years as FLT driver - never had an accident & diabetes under control & regularly monitored by GP. Now Tesco's say they don't want insulin dependant diabetics opertating FLT's & I think this is unfair & could be discrimination?
Additional Details
They employed him knowing he is insulin dependant diabetic. It's on his licence.

This could have something to do with their insurance as all Tesco stores etc are insured with Tesco insurance.There was an article in the papers some months ago about a customer, who was insured with Tesco, had an accident on one of their store carparks with a pile of trolleys that had got away from the attendant who was collecting them and they wouldn`t pay out because it happened on their land, involving one of their employees and the car driver, who were all insured by Tesco and in effect they would have been suing themselves.

As far as I know there is no legislation preventing you driving, however company policy is another thing. Talk with your HR and GP.

Tell your friend to tell their union rep:

Youre friend will be covered by the Disability Discrimination Act 1995.

Get an appt with Occ Health or GP signing him fit on the grounds that he is a well controlled insulin dependant diabetic.

Tescos will have the health and safety of others in mind, but in my experience of a HR manager in the manufacturing industry, as long as Occ Health say its ok, and he is well controlled, there is no issue here.

I think this is unfair.You are allowed to drive a car for goodness sake.Consult your union rep.

I have just got my R.T.R.T.B COUNTER BALANCE AND REACH. They didn't ask me if i was diabetic.

remember they have your health and safety and that of your co-workers in mind.
I do know that HGV licences are taken once a person is insulin dependant diabetic.
Unfair as this all sounds remember that insulin dependant diabetics can often have problems such as hypo's and collapse. I am not saying this applies to you BUT in this day of increased litigation many employers are over cautious and not willing to risk it.

No since they knew that he was a diabetic and never had an accident. They should be explaining to him why he is not doing his job and what job they can offer him. Since they do not want him to work at his job they need to be offering him a job with the same pay or retrain him to do another job. If he is not being payed then he need to get a lawyer. If he is not a risk to other he should be allowed to work at his old job, they may require him to see a doctor to make sure that he is healthy.

Extremely discrimatory... i've recently been studying a little law at uni and i would be quite certain that they will not be allowed to do this... being a diabetic myself, it makes me even more mad!!

Tesco are within their rights to do this if the diabetes was not mentioned prior to employment. It's a safety issue.

Looks and sounds like discrimination. I cannot think of one reason why someone on insulin should not drive a fork lift. Unfortunately, I do not think diabetes is classed as a disability, so I am not sure under what legislation a claim can be brought

Diabetes IS covered by the disability discrimination act, and you are under NO obligation to tell your employer about diabetes.

I would get your friend to read up on the act and find out what his rights are
