USAF Stay At Home Mom/Wife Possibly Facing Divorce. Could I request my husband pay any legal fees?

My husband wants a seperation/divorce. Sometimes anyway... He's never really sure.
I don't want it because I think it's ridiculous and I don't think his reasons are valid enough for a divorce (I don't look as hot everyday like I used to, the house is not always **** and span when he gets home, he has an xbox addiction and I don't like it...). They are little immature excuses. In my opinion...

IF he were to file for seperation/divorce and I needed to find a lawyer to represent me, could I ask that he pay for my legal fees? I am a stay at home mom. He's in the air force. I don't have an income and there are not any lawyers around here who are nice enough to take pro bono cases or at a discounted price.

Also, if you've ever been in my situation and had to find a way to get on your feet on your own with a small child after being a stay at home mom, please tell me how you did it. Or if I have any rights or legal options.
I don't have any friends or family that I could stay with to get back on my feet so I'm in a tough situation.

Of course you have rights and contrary to what the PP said you cannot and will not loose your child because of an income issue. Were that the case a good many women would not have theirs, children, right? You need to talk to a lawyer. Consults are free in many cases. Have a list of questions, about custody, about wether or not you can sue for your fees, and especially about income. if you have been married for long enough you *may* be entiitles to spousal maint., but only for a short time so either way your really going to have to get a job at some point. see several lawyers. Some are better at answering questions than others during a consult, so don't be shy about scedueling several. Talk to the military. Look up your states divorce laws, because they vary from state to state. I live in a 50/50 state, meaning assests are divided evenly. On the other hand, you could just file a seperation and move out or(make him move out!) request he continues to pay the rent/mortage for a certain number of months until you get on your feet, or until he gets his head out of his a**. You have options. most importantly look the laws up in your state. Good luck!!

Since your husband earns the income in the family, he will have to pay the legal fees. You really need to see a lawyer about this. I believe the US military has offices who deal with family issues, and you should consult them first. They may even provide a lawyer.

What state do you live in? It depends on the state, but usually the person with more money pays the other's attorneys' fees during a divorce case.

You can also try Legal Aid in the county/state you live in. They do take some cases for indigents and I think family law is one of them.
