Unemployment/Severance?

I work for a company X. Company X has a lot of subsidiaries. My subsidiary is being eliminated but Company X wants me to go work for another subsidiary (the work is equivalent) so I will have a job. I don’t want to work for this other subsidiary. Company X is basically saying you need to submit a resume and interview for this other subsidiary or you will be refusing a job and you will not get unemployment/severance. If I was offered the job and I refused the job then I understand I wouldn’t be eligible for unemployment but why do I have to submit a resume and interview at a company they already own. Why can’t they just transfer me? Company X is not offering another job or transferring me, they are just telling me to apply for the job or else. If I don’t get hired at this other subsidiary then I will get unemployment. Is this legal? Please help!

wholly owned subsidiaries are still independently operated businesses so you can not "transfer" from one to another.
you work for the subsidiary not company X.
severance does not have to be offered that is a policy decision and not mandated by law(in the US).

failure to apply for a comparable job that is hiring is grounds to be denied unemployment compensation. if you apply and are not hired then that disqualifying event is not an issue. by dealing with this now they are actually making the hiring decisions before you apply for unemployment which will actually help you qualify for unemployment.....................they are making every effort to assist you and you are looking at it like they are trying to take advantage of you.

Sure it's legal. The subsidiary might run fairly autonomously, and have the right to select who works for them.

I had this same thing happen at a large company. They gave us the option to apply for other positions. If you chose not too you were still able to receive the severance package but not the unemployment. To receive unemployment you have to be actively seeking a job and turning down an interview for a job at another branch is assumed not actively seeking a job.

Unemployment and severance are two separate items, make sure you ask about them separately.

My department was let go and, even though we were encouraged to apply for other positions, it wasn't reallly talked about. We were still eligible for unemployment.

I guess it depends on the situation. Contact your state gov't to find out the rules around unemployment.
