Unemployment process?

I just file for unemployment yesterday. I did quit my job due to "Constructive Dismissal". I have proof of unfair treatment and ready to fight if they challenge it. Just want to know how long does it take before an answer and if anyone can give me a step by step process? I'm in NYC.

It is not retroactive, it is based on file date. You better get ready for a hearing, you will likely have to prove your case.

Constructive termination means you will collect. The process takes exactly 7 days from the day you filed (remember the first 7 days of unemployment is not paid. Meaning the first 7 days from the date you lost your job.) If you have not received anything from UI call the 800 number immediately. You are in luck. There is a 13 week extension once the regular unemployment runs out plus an additional 7 weeks was just implemented in New York. Good luck!

Unemployment is not retroactive. If you were discharge the company can in fact fight it. Unemployment does not handle those kind of discharges but given the economy they might let you have it.

You on the other hand you should file an EEOC charge and have them investigate the constructive discharge case and then fight it personally if they see a right to sue. That way you can sue for damages and back and front pay as well.

I would ask for a copy of your personnel file as well.

As long a you can prove it........but........with the economy the way it is anyone who walks from a job is in for a heck of a fight before they give out any money.........get where I'm going with this..........your have a long ways to go before you get any answer.........unemployment is not retroactive........they will challenge it.........
