Unfair dismissal .... I was on a job for 8 months ... company sacked me unfairly ...?

contract has not been signed by the company for 8 months ... can I call for a employment tribunal service?

I was unfairly dismissed from a company after working there for 9 months, and it turned out that I had no legal rights unless I'd been working there for a year or more.

The law may have changed since then - I would suggest phoning / visiting the Citizens Advice Bureau (their details will be on the internet) and asking what your rights are in your specific situation

for a case to go to an Industrial tribunal, you have to have at least 12months service.

If you are in the UK -
You cannot take the company to a tribunal for unfair dismissal as you have to have been employed for over 1 year.
A 'contract' does not have to be signed - it does not even have to be written. Many elements of a contract can be written in an employees' handbook, or can be verbal in nature, or can be established by custom & practice.
The written document an employer must give you (within the first 8 weeks) is a 'statement of particulars' (often inaccurately called a 'contract') which should give details of your job title, pay, working days/hours, notice periods, holidays etc. This does not have to be signed by either party.

You can't claim for unfair dismissal until you've been with a company for at least a year, but you can talk to ACAS and get advice regarding your contract as the company had a legal obligation to provide you with one.

They have to sign it sweeie for it to be worth anything

If you submitted a contract that was signed by you that was also signed by them then yes. If you don't have a contract that states your job description, your duties, any extra duties that can be expected of you from time to time, your hours, your overtime or unsociable hours allowance, expense allowance etc then I am afraid they can state almost anything in their favour. I would ask at the Citizens' Advice Bureau or if you are a Union Member call a representative.

surely it would depend on what they sacked you for.! you may think it was un-fair but do they? why had they not signed your contract in the first place? if its not signed then you dont have a legally binding contract. They could just say they employed you as a temp and never mentioned a temp to perm position hence why no contract was signed. cant really advise anything else as you havent given much to go on. sorry but good luck!
