Unfair employment practices at my workplace! Help?!?

The company I work for doesn't have an HR policy established, we didn't even get a HR policy handbook when we got hired, yet they are firing people on the spot for no reason! I just found out that there is a job posting, that my company put up online for my job! We have no union, I'm planning to hire a lawyer, but is there another agency that can help me out with this?

What exactly do you think a lawyer will do for you? I'm sure the company, no matter how poorly run, can hire and fire at will unless you belong to a protected class of employees. If I were you, I'd be looking for another job and get on with life. I think this company may be in some trouble and, in a panic, they're firing people in an attempt to turn their financial problems around. You can't force them to retain you, nor do I think this is a place where you should want to work. It sounds pretty scary. |

If you live in an "at will" employment state, employers have the right to let employees go without justification. The legal foundation for that approach has been tested and withstood challenges. If you believe you've been harassed or discriminated against, you may have a case, but otherwise it's an unfortunate reality of not being your own boss.

Even if you did hire a lawyer and the lawyer saved your job. Why would you want to work a company they treats their employees like that. Your best bet is to find different employment and move on with your life. |

Employers are not required to have HR policies or handbooks. The default employment relationship in most states is employment "at will," meaning you can be fired for any reason or no reason (the exception is where the reason is prohibited by law, such as racial discrimination). From the facts you gave, I don't understand why you would hire an attorney. |

The law doesn't guarantee "fair" by your definition. It only guarantees that you can't be fired, or treated poorly compared to other employees, because of your being in a "protected class" - these are things like race, gender, and age over 40.
It's legal to file someone on the spot for no reason, and there's no legal requirement to have a policy handbook.
I'm not sure what you think a lawyer will do for you other than accept your money. Most lawyers, the honest ones, will tell you this up front. |
