Validity of my contract - Urgent?

I signed a contract with my Ex-employer in 2007 - but they asked me to put the date in as 2005. Moreover it was signed by a receptionist and not a higher authority, the receptionist is longer wid the company.

Question - is this contract still valid??

The first question is what proof do you have? Your saying it won't be enough to sway a judge.

And yes the receptionist can be a company representative as that signature is designed mainly to say someone witnessed you either signing directly or turning the signed documents in.

It doesn't matter if she is still there or not.

As for the back dating itself - unless your issue like a noncompete after a layoff is from before 2005 it probably won't matter much anyway.

If you have a lawyer friend you can bounce it off them as contract law varies a bit by state.

The fact alone that the contract was back dated two years as of the date of its signing would make it invalid. And the fact that it was a receptionist that signed off on the contract? That can definitely give the company grounds to say it is unenforceable since it was not signed by a company official.

I have to agree with rusheven. Having the receptionist signing is probably not an issue. It's a common practice. Contracts do not always need to be signed or witnessed by someone in higher authority.

Backdating is definitely an issue - do you have a witness that you were asked/forced to sign a backdated item? Otherwise it can be tough to prove.

I agree the backdating issue is probably worth consulting an attorney specializing in employment law. Good luck.
