Verbally and Letter ?

When you hand over a resignation letter is the employer have the right to say he dont want accept it. And do you need to stay there when they say no one is available for the position. From my view if you resign then it is better to resign .
I have a contract signed. But in it it do say I must give notice before a month. Being Sponsored as I am foreigner can I terminate it myself at the Immigaration department myself without noticing him , since the employer refuse to let me go?
Will I be bound to legal fine?

Well, this depends upon the terms of employment. The terms of employment usually stipulate one month's notice or payment of 1 month's salary. Employer , in any case, has no right not to accept a resignation !!

Ugh -- Another low life abuser. NO. You will not be legally fined at all as long as you stick to your contract terms which is 30 days notice which you have done. It doesn't matter that you are being sponsored. Big deal! You will not be the first nor the last. Nor can they make you reimburse them for any monies spent to sponsor you unless it is in the contract you must give them X number of months or years to fulfill your part of the bargain. In fact, these types of contracts employers must be careful with since they may be in violation of Human Rights laws. For example, asking someone to remain employed for the next 10 to 20 years is viewed as a form of servitude (slavery.) The immigration department has nothing to do with this. If your boss didn't want to accept it then give the letter to someone else. If they do not want to accept it then continue working up until your last day as indicated in your letter of resignation and be gone. Let them go to hell. This only applies if you are in the United States.

My brother worked for an IT consulting firm in manhattan before he became a cop. They use to do the same to there sponsored employees. Only one person was smart enough to scream attorney.

If you give you resignation and work out the month's notice, your employer can NOT say "NO" or keep you at the job. Whether they have found a replacement or not, is not your problem. you are still entitled to leave if you chose.

"Not Accepting" a resignation is when the employer offers you better work condidtions, pay, oppourtunity, in an attempt to get you to stay. If you don't want to take their offer, you have the right to leave.

Sounds like your employer is trying to take advantage of your lack of knowledge. If they do try to force you to stay, seek legal aid, whether from a community law centre or immigration.

don't know about contracts. there may be penalties if you break a contract. bad references could occur.

Contact your local state department of labor and/or immigration office. It never hurts to ASK before you take action.

Because you signed a contract and they are sponsoring your visa, you may have to leave the country.

You cannot be fined, but they might be able to take legal action in the civil court.
