Were my FMLA rights violated?

I had surgery on my leg and a week before my follow up visit I asked to file for FMLA due to inflammations that are common with the procedure and because I will be having the same procedure done on my other leg. I was told by the HR manager to "Wait and see what the doctor says."
I decided to attempt to file again and was handed a request form and a Certification of Health Care Provider. I was never informed of my rights, I still have not received an Employers Response Form. I also had to go to the doctor again to have the form filled out. I could have had that done the first time I asked to file. All in all I have no idea whether or not my claim is granted.
What is my best course of action in this situation? I appreciate any help on this matter. Thank you in advance for your time and consideration.

You can't file for FMLA for something that MIGHT happen, like the inflamations, unless you already have them and are unable to work per doctor's orders. If you will have to be off work for an extended period when you have the surgery on your other leg, you can file for it then. |
