I recently quit my job, and they refuse to send my paycheck via mail. My last day was 4/10/2009 and we get paid on a bi-weekly basis; which means my check should have been mailed out on 4/16/2009... Apparently it wasn't because I'm one week shy of a month from then and still have no check. I've tried to contact them via US postal service, telephone, and e-mail and get no response. I'm already in the process of taking action through my state's labor commissioner, but was wondering if I should do anything else or just wait it out and see what happens with my claim. I need advice!

what state did you work in?
laws concerning pay-periods, pay-days and final wages vary by state.
when did the pay-period END for the last day you worked?
only a few states require payment of wages prior to the normal pay-day for the last pay-period if the employee quits (which you stated you quit).
not all states require that the employer mail your last check if you request it. it is your responsibility to pick up the check as if you were still employed (again this varies by state)
have you gone to your old employer and asked for your pay-check?
that would be the most logical choice to make..... |

yeah you should definitely call your state "bureau of labor and industries..you should have received your paycheck within 72 hours..i would call B.O.L.I then call your place of employment and let them know that you have already called them..i was in that same situation once and my job tried to with hold my last paycheck, and i lied and told them that i called boli and my boss( who could issue the check )said to come and get my last pay check in a hour. |
