What action should be taken against a person who had submitted fake educational certificates to join company?
Find answers to your legal question.

What action should be taken against a person who had submitted fake educational certificates to join company?

He had provided fake certificates at the time of joining. How to take action so that he gets black listed across the industry and some legal action can be taken against him.
Thanks in advance.
Additional Details
Can the complaint be lodged with the police anonymously without involving the company? How should it be done and what proofs should be submitted for that?

If you are in the US you can terminate him immediately. And if they company is smart, they will.

Blacklisted across the industry is a bit of overkill. He'll either learn from his mistake and not do it again, or he'll try it again and get caught.

Police intervention is not necessary UNLESS this person claimed something like a medical degree which put the health of others in danger.

Good Luck.

I was an elected union officer for twenty-five years.

If an employer hires an employee who it turns out later has falsified his or her qualifications, the employer can dismiss the employee for that reason alone. This is true regardless of whether performance is satisfactory, and no matter how much time goes by before the employee is found out.

You may be certain that the police will not be interested. There has been no criminal offence. Even if there were, I would like to know how you could submit proof without identifying the company or the complainant.

I don't know why you would want to blacklist the employee. That is vindictive. Just fire him, or her. Dismissal is considered to be the capital punishment of labour relations. Unless you think that the fake certificates (maybe a false criminal record check to conceal a pedophilia-related conviction for someone working with children), there is no good reason for you to damage the person's chance of getting another job.

The HRD department refers the matter to legal department. They issue a "show-cause" notice to that person. The person is asked to give explanation with in specified period. If that person fails to do so - the first action is terminate ther services. In some cases, the company lodges crimial complaint ( Section 420 of Indian Penal Code) with police and legal case is filed against that person. Some companies terminate the candidate and publish a small advertisment in news papers about this person with his photo.

You can sack him straight away quoting this as the reason. However, it is safer to take a letter from him to this effect. Then you can hand him over to the police for cheating knowingly and with intention to benefit.

IPC 419 and 420. Its bailable but arrest is compulsory is the convict does not surrender.
