It depends on whether the company has a trademark. |

You can get sued.
You have to be very, very careful about that...even if it's close, if you are using similar colors, similar logo...they will sue.
Considering the legal power of major companies...it's a battle that would be wise not to start. |

That you will be sued for trademark/copyright infringement and be forced to change the name of your company. If your company is in a completely different field than the company whose name you are mimicking, you may be ok; if you are attempting to distract from a competitor in your same field, there are pretty stringent laws with respect to that. Check with a lawyer in your area before you incorporate or otherwise christen your new company after a famous relative. |

Legally you can get sued. If the very well established company and its flock of high-priced lawyers win, you will be liable for court costs, their lawyer fees, and any other amount the court wants to impose for willfully trying to defraud consumers with a similar name.
Even if the well established company decides to settle with you out of court and demands that you change the name you will be out money. There are the little things like re-doing corporate papers, letterhead, business cards, etc. that you will need to change. Which does not even come close to the loss of business you can get when dropping one name and picking up another. |
