What are the advantages of laying off a person as opposed to firing them?

I want to get rid of someone. Are there any advantages of Reduction In Force versus just firing them without a reason?

This happens all the time where I live. It happened to me a few years ago, it happens when people get old and close to retirement. Just last month a shop was trying to organize and they had RIF of all their drivers.

Early in my career...my boss fired without good reason...I got a great attorney...sued him personally....the co many and the vice president of human resources personally.....I took that money and invested it....I retired at 50 with a place bay side South Padre Island Texas....fishing great....I thank that ignorant @ss every day...

Try it.... perhaps you will get someone like me who loves a law suit...

there is advantages in laying off. people look at the employment money, but it's not about that at all, it about replacing that person with someone with more speed on doing the job and how versatile they are and are they a team player. You always want a team player because if you get someone who not then you tend to have lots of problem and less production. Firing someone well you better have documents that show that this person is insubordinate, and have been notified about there behavior/action and been warn many times before firing.

if you lay someone off because the job is no longer needed, and then hire someone else a few weeks later to do that same job, the person you fired has the legal right to take you to court and get their job back.

If you want to fire them , then FIRE them with cause and state the cause. They cannot get unemployment insurance if they have been fired with cause. And make sure you have proof. If you fire them with no warnings and no proof, they may be able to take you to court and sue.

If you havent given them any warnings - then start giving them warnings and document them. You will need to give them 3 warnings (no more than 1 per months) time for them to improve - before they can be fired - and only if they do NOT improve.

if you lay them off they can collect unemployment which you have to pay into, if you fire them for cause they CANNOT collect unemployment

If you Fire them you will have to have good reason or you will be sued.. If you lay them off you may have to pay them Redundacy ..

I'm not sure about lay-offs, but if you get fired you can collect unemployment.

No really any advantages,,,,U will have to hire someone in place of them,,,,,and They can File unemployment eitherway...Firing,,,I guess could get a little personal rather than a layoff......Most employers R to chicken to fire anyway.

there is some advantage like if you fire them then you dont have to give the reason to anyone by law

really its just if you have a personal grudge or not but good luck with what ever you decide
