Is there any legal way for an employer to not pay overtime to an hourly employee for anything over 40 hours a week? (Tax forms were filled out and it is full-time in summer and part-time in winter.)
Also, if someone works 8 hour shifts and is a full-time employee, what breaks are required (even if they are only offered)? I always thought it was 15 minutes for every 4 hours worked and a 30 minute unpaid for anything over 6.
This pertains to working in Colorado.

Federal law requires that all hours worked over 40 must be paid at time and a half overtime rate.
Federal law requires that you get a 10 minute for every 4 hours worked. Because federal law requires all breaks less than 20 minutes be paid these breaks must be paid.
There is also a meal break requirement in CO of 30 minutes. If workday is at least 5 hours. This does not have to be paid. |
