A colleague of mine had asked me for financial help. He promised to return the money in 2 weeks. However now he is not answering the phone nor is he returning back my money. He had acknowledge the receipt of money in a email. But I do not have any other documentation other than the money transfer which I had done from my bank. Is there any action which I can take. The transaction has happened in US

You can definitely go to small claims court and trust me you have a case keep your email,keep the transaction regarding the transfer. You have to really prove yourself it is somewhat your word against theirs but the judge using his/her own discretion. If the judge finds and character flaws in the defendant for instance he can use that as his/her judgment if he wanted. It really an open book case. |

You can look into filing a claim against the individual in small claims court - that has to be done in the city where the transaction occured. Be advised, that you will have to pay fees to file in small claims court, and even if you do win the case, the court can not actually do anything to force payment from your colleague.
Is this a work colleague - a co-worker? Perhaps you can bring this up to HR department as an internal complaint? I am not sure there is anything they can do, but perhaps talk to him about the situation - if their job is on the line, they may make more of an effort to pay you back. |

without written proof or witness, its kinda your word against theirs, but if you do have proof you can take them to small claims court depending on the amount. |
