I was poop canned at my old job, and I thought they could only give dates when employment history was checked, yet they told my prospective employer that I was fired. I am in Massachusetts, as laws differ from state to state.

The only information former employers can divulge to anyone is your dates of employment and job title. If you listed a specific person from your former job as a reference on your resume or application, then that person can answer any questions they are asked. But if your prospective employer contacted your former employers reference check department/phone number then as a company they cannot divulge reason for termination. |

Unfortunately, there are no laws that forbids an employer from giving a bad reference. HR departments won't do it for fear of litigation, but not that they are following any laws. It is just a smart move especially if the person was knowingly wrongfully terminated and thereafter they also offer a bad recommendation this could certainly be viewed as a retaliatory act. If you can avoid using this employer that's what I would do. Or if you have a friend in the department who will cover as your supervisor and offer you the recommendation. Lastly, if you are really concerned about the type of reference they will give you can use a reference checker. I actually used Allison Taylor and they got me the information I needed. |

there is no law that says a you can't be given a bad reference, if you were terminated for cause and where denied UB than there is no reason a prospective employer shouldn't know about it. if you fired for drugs, fighting,stealing, etc. Any employer has the responsibility to keep a safe and productive workforce, why do you think they do background checks. |

Hilarious, big no no. I wouldn't use a former employer if I was ever fire, because it's a risk worth not taking. Especially if you have to pay rent, and feed the family. You boss was being honest.
Off the subject with respect to background check.
Today is a lot easier for anyone to do a background check with very little costs. Because of the Internet background check is like ordering pizza from your local pizzeria. The difference is that I'll get a quicker delivery when I do a background check then you would if you order a pizza. |
