Making a very long story short. I lost my job a few weeks ago. I worked at a Church daycare and I got fired because I missed too many days of work. Ok I missed too many days because I have a daughter that was born a premmie 7 weeks early. She got sick a lot within her first year of life and Im sorry but my child was a miracle that she was even born let along that she survived. They got a new preacher while I was out having the baby. He doesn’t have kids and at first didn’t want anything to do with the daycare but then decided to take it over because it was more money for him. Now I know preachers are so holy it peoples eyes, and I still have no bad will towards him but I really am concerned about something. I know that all there allowed to say is yes I worked there for 3 years “yeah worked there for 3 years without missing a day before the baby” and they can ask if they would hirer me back.. Im starting to wonder if there saying other stuff that’s effecting me finding a job. I have applied everywhere. Im so frustrated because I know I work hard. I can’t get unemployment because the daycare doesn’t have enough workers to half to apply to that rule. I even applied at a gas station because I know as a mother I half to have a income too support my daughter. I have years of retail experience and that’s where it got me wondering if there saying something bad. Yes I did miss a lot of work but my baby will always come first. Now that she is almost a year old she never gets sick and I haven’t missed work in a while he just spuing this on me and said “ its not our fault your stupid little child keeps getting sick” But yet again preachers are holy and its his word against mine. Ask yourself this, are you going to believe a person of god or a job-less mother trying to find a job. How can I find out if there saying something bad. I live near Charlotte NC if that helps any. Sorry that was so long. Now with that said. Is there anyway I can leave the daycare off when I apply for jobs. Are companies able to check that threw your SS#. I have applied to jobs I know im over qualified for and still nothing and with the baby I really need to find something soon and im not being picky about it. Sorry so long thanks for your time.

the church probably does not qualify under FMLA but you should check

but that has no real relevance since they can still fire you for any or no reason. this would help if you were covered and you were to apply for unemployment insurance.
unemployment does not matter if you quit, are laid-off or fired but rather WHY you quit or got fired.
you are correct the church may not be covered under unemployment insurance but you need to file anyway (if you did not already) to be sure.
the employer may release any truthful information regarding your employment and if you list them as a reference on a signed application that is a release in every state that requires one (which is very few).
a lot of people are having a hard time finding work and the fact that you can not get a job probably has absolutely nothing to do with the church daycare. it is a poor economy and even businesses such as retailers and fast-food who are usually always hiring are NOT. just brush up the resume', apply everywhere you can and stay positive. you should also seek any other temporary assistance that may be available through the state or federal programs to assist you, that is what you paid your taxes for. |

Some people (law enforcement, etc.) can have access to your recent job history through the state, in many cases. It is not easily available through public records.
The daycare may or may not be badmouthing you; without having somebody call on your behalf (assuming they recognize your voice) asking employment questions, it would be hard to tell.
If you are applying for non-day care type of jobs, you don't really need it on your resume. Be upbeat in any interview, saying that you worked at a daycare center but you wish to explore other employment opportunities at this time.
Another avenue to explore is did they terminate you against the family leave act. The rules (laws) can be complex, so check this with an employment lawyer, or state employment resource. |

Did you file for unemployment and get denied benefits? Employers are required to pay in for that for their employees. You should log on to your states unemployment web site and file a claim for benefits. If you lost the job through no fault of your own (did you quit or did they lay you off?) then you would be eligible for benefits. If you quit the job then you would not.
As far as what an employer can say about you, if you sign a release for them to release information about you then they can release all truthful information about your employment with them, including attendance.
Maybe have someone call them up as a prospective employer and ask some questions of them to see what they will say about you?
You do not have to list the daycare on your resume if you do not want to. You would need to explain the gap in employment (what were you doing during that time if you were not working there).

A church / daycare with under 50 employees are not obligated to pay into unemployment benefits, nor do they fall under the FMLA guidelines. I work for such an establishment and have dealt with employee's who have been let go due to poor attendance, etc. It is one of the pits of working such a job. I am sorry you lost your job, and I totally understand your need to be with the baby, but on the other hand the daycare has children to be cared for whether you come to work or not. SOMEONE needs to be there, and if you cannot be, what other choice was there for that daycare, than to replace you? God Bless. Try not to be bitter, God has a plan. |
