My husband has been working with his company for 4 years, and he's been the assistant manager for 1 1/2 years. Now he has been transferred to a different store and has a new district manager who is buddy buddy with the store manager. They keep writing him up for stupid little things and they've even had the nerve to ask him to step down his job position or get wrote up again and get fired. They have these monthly things called cycle counts and they are the management teams responsibilities. There are 3 managers but he is the only one that got wrote up for them not being finished. I think that they have someone else that they are buddy buddy with that they want to give his position to. Is there anything that we can do?

Unfortunately, favoritism is not unlawful discrimination. If your husband can show that he falls into a protected class (age, race, religion, national origin) then he may be able to show that there were improper reasons for his adverse treatment. For instance, even though you say it is favoritism, if the other managers are all under 40 yrs of age and your husband is over 40 yrs of age and they try to replace him with a younger manager that may be age discrimination. People tend to be "buddy, buddy" with people who are similar to them and if they eliminate others who are in a protected class because they are dissimilar that is unlawful discrimination. |

Contact your local bar association. They will refer you to a lawyer who will meet with you for about an hour, and then you'll learn if you have a legal case. Sounds to me like you do. Gather as much evidence and documentation that you can for when you meet with this attorney. Good luck. |

If so then
Is there less than 101 employees, if so then under the current IR laws there is nothing you can do.
If there is more than 101 employees in the company then yes the IR laws cover him. |

If those 2 are investigated, they will find a way to pass the buck ... probably onto your husband.
"DIVIDE AND CONQUER" may help ... is there any way to get one to talk about the other? invite one to a golf game or suggest a company innovation over drinks then get them talking?
If one finds out the other spoke of their faults, they may be less buddy-buddy |

If your husband can prove it, then he should report the situation to the regional director or whoever the district director reports to. But keep in mind, if he does this, then this means a direct confrontation with the district manager. So, he better has a backup plan if things do not work out.
Your guys could pursue legal action again them, but keep in mind that this may be a long and dreadful process before you see any result. And, in the end, the lawyer might take most of the money. |
