What can I do if my employer fired you cause your Dad had to be taken to the hospital?

Well my dad almost died and the doctors kept calling me to tell me about decisions i had to make and if i didn't make them they would but i had to make them so i had to go to the hospital i was surposed to work 4 hrs that day and they told me i had to come in or i would be fired so i told them i couldn't and i lost my job what can i legally do?

Accually i'm a Vet and its The Fresh market And you say i lie no i dont i live in florida i servered in the military for 4 years and I know the laws theres about 90 people that work there and My dad almost died and if i didn't take him he was done for he couldn't go to the hospital down here as he has no medical and he is a Vet and i told my work my Family is more important to me and if your Dad at 62 almost died you would have done the same thing

well i know i'm not in law school yet, but i'm pretty sure they can't fire you just because you had to miss work since your dad was going to pass away

Yes, I'd have done the same thing - gone to be with my dad regardless of the consequences.

You can't legally get your job back - they have the right to fire you. But if your record before this incident was good, they are pretty weird for doing so - and I'm not sure I'd want to work for them anyway.

I don't think you have any right, but it is important to give what state you live in. In CA an employer needs absolutely no justification to fire anyone. Unless you think this is discrimination I think you are out of luck.

Please, lie to yourself but not to us. They wouldn't fire you for a first offense.
Your one of those people who are overly dramatic and this SURELY wasn't the VERY FIRST time they ever had to put up with your B.S.

Besides, you can just get an assistant fry cook job at some other burger place (I'm guessing you weren't head surgeon at the local hospital).

I'm a vet too. 6 years in the Navy with NSWC and then onboard USS Tarawa LHA1 down in San Diego. If somebody is about to die a hospital will take them regardless of their insurance status. I COMPLETELY stand by my contention that your an overly dramatic person. Your dad was surely done for and your the ONLY person on Earth who could save him? What are you Batman? My "weirdo radar" is also giving off alarms of codependency issues with you and your dad. Maybe its time you cut the umbilical and got your own life together and stopped living as if your only reason for being alive was to take care of him.
See, with being codependent your able to blame your life on him. You can't keep a job because he needs you to live. Your using him as a crutch. Time to grow up hun. Next time he almost dies he can call 911 and everything will be fine. I'm guessing the ambulance that comes and gets him will be better suited to take care of him than your 1982 civic, so its probably doing him a favor not having you around.

First off it matters what your company policy is on emergency leave. If its states in your workers handbook, that your company in fact does allow you to to take a leave, then you have a chance.

not all companies have the same policies nor are they required by law to allow you time off for any medical reasons, other than your own.
it is correct that they cant fire you on first offence, you must receive a written warning before they can fire you. if you have, for any reasons, received either a verbal/written warning and you have been at the company for less than 90 days, no warning is necessary.

if you HAVE been at the company for more than 90 days and received no warnings (for any reason) you will need a doctors letter(from the same doctor who treated your father that day.) stating your fathers ailments and
why your presence was necessary on the day in question. you will then need to contact a lawyer.

It depends on how many employees your company employs, as to if they are under civil rights laws. Find the federal EEOC office near you and inquire with them. Tell them the name of the Company, how many employees at the location you work at (approximately), how long you worked there, if full time or part time, what you did, and what happened. They will let you know if you are eligible to file a complaint. Good luck.
