What can I do if my job of 10 years will not give me a written reference?
Find answers to your legal question.

What can I do if my job of 10 years will not give me a written reference?

I am applying for new jobs and all require two professional references, without them I cannot get a job. Their reason? I am a complainer. I wouldn't work for no pay, work through my lunch unpaid, wouldn't allow my supervisor to use profane language etc.. I have my complete personnel folder that includes 2 promotions, a merit raise and the one job review they gave from 2001. I worked in Massachusetts and am now in Virginia.
Additional Details
Am I elligible to collect unemployment if I cannot get another job because of this?

Can you use the info from your file as a professional reference? Most companies are not allowed to give written or verbal info out about the employee b/c of liability reasons so I can't imagine that they won't accept anything else. Can you submit a copy of past reviews? Do you have any co-workers who can write the letter for you, do you have any former bosses who no longer work there who you keep in contact with? Maybe they can vouch for you. Good luck!

Dear ''complainer'...

No organisation should encourage you to work through you lunch etc and I understand you wouldn't work extra hours for no pay! HOWEVER its important that you are enthusiastic and committed to your role & performed well in your duties & sometimes that means possibly working through the odd lunch break or even working that extra ten minutes at the end of your working day to make sure things are done!!

I obviously don't know your employer & certainly wouldn't anyone in my company to use profane langue especially co-workers. Have you created a strong working relationship with you employers & managers? You obviously performed your duties well and have received two promotions in your working career with your employer. Of course they will issue you with a written reference & surely a verbal reference however your employer is obliged to say NO to a written references not sure if that applies to a verbal one. HOWEVER it is likely that they will give you a letter in reference and very likely to include nothing other then your current role & how long you've worked for them. I can't imagine why they would include other positives there such as commitment, worked well with co-workers etc..... when you obviously weren’t very flexible to them

It is vital to any organisation today that individuals are open to new experiences & are sometimes flexible within their current role & willing to take on additional responsibilities. I would question your commitment to the organisation & your co-workers if you weren’t willing to go that extra mile on occasion!! i.e this may go against you in your seeking future employment elsewhere as they will seek it to be backed up by your current employers when they look for a reference

your previous empl0yer is under no obligation to give you a reference and if they do they are justified in telling your potential employer as you said a complainer, there is no law that prevents them from doing so, no you cannot collect unemployment benefits

Use coworkers instead....I would never ever tell a company that I'm looking for a new job, particularly my boss. You'll find yourself out the door and on your butt quicker than you can think...especially if they label you a complainer.

As for unemployment, you can only collect if they laid you off or fired you...not if you leave on your own.

If you got their reference, and they were candid, you would not wish to have and use that reference, based only on what you have said.

Your employers may have a strong dislike for hiding unwelcome information when asked for an honest opinion. This is something we have to keep in mind when we set out to define our relationships within a workplace. We should always be sure that there will be some people within our workplace that will think lovingly of us. It really helps if some of those are our supervisors.

Most companies do not allow written or verbal references, we just verify employment. You are still eligible for unemployment benefits, employers are not going to look you over just because your employers will not give you a reference its not mandatory.
