What can he do, really? My husband was "let go" for "refusing to take a post-accident drug test but he DID go!

We moved this weekend. It had been planned for months. Friday night my husband's employer asked him to work Saturday night 3-midnight. Because he IS such a loyal, honest employee, he went to work despite the fact that we had to move. Around 9:30 pm, another employee crashed his forklift into my husband's. They sent them both to a drug test at Care Now. But, it was closed when he got there (they close at 8 or 9 pm). The next day, he went to take the drug test, but the place was close AGAIN- despite the fact that his "referral sheet" said the hours were from 10 am to 6 pm, and it was just after 5 pm when we arrived. So, he went yesterday. (The entire two days he continually checked in with his "lead man" and his "lead man" repeatedly told him that he "got his back" and not to worry.
Today, he showed up for work and they said he was being "let go" for refusing to take the drug test.
Is there absolutely no recourse for this injustice? Please help!! We need his job and his insurance!

Before you incurr the cost of hiring an attorney on this case he needs to speak to H.R. directly to explain the merits of the situation. If the accident happened after the clinic closed then that is a fact that can not be disputed by H.R. or his boss. He needs to speak to someone there in H.R. or management and tell them what happened and his attempts to comply with their direction and policy following an on the job accident. If that does not work then he could file a complaint of wrongful termination with the E.E.O.C. (Equal Employment Opportunity Commission).

Sounds to me like he made reasonable attempts to take the drug test. Call an attorney ASAP!

Contact the HR department and splain wassup. Have them contact his lead man. Have the lead man contact them. It is unlikely he will be fired. I would not contact an attorney just yet.

Just curious ... Did the other person get in for the drug test? You husband needs to realize that there's a time limit on this. He should also realize that his job depends upon taking the test. If my job were on the line, I would have camped out at the test center, no matter how long it took. Instead of checking in with the lead man, he should have been checking in with the test center.

Ok, so he didn't do it the correct way. You're going to need an attorney.

If you live in Florida you can not do anything about it for on the application that you fill out and sign it always says that they can let you go for no reason at all.He should have gone to a walk in centre or checked with his main office and let them know what was going on.The way it looks like to me is that he was on something and did not want it to show up on the test. PS. never trust someone that works with you they are the first to stab you in the Back.

Contact your State department of labor first. If they are no help consult a lawyer. Your husband was at fault because he did not show due diligence in trying to get into the testing center, but there still may be a way to get around this. Do not depend on the lead man he obviously did not have your husbands back.

Get an attorney as everyone else said and make sure to write down the dates, times and your husband's account of everything that happened while it's all fresh in your heads because you'll need that. You might also want to go by Care Now and get a letter or some kind of verification that they closed early or whatever.

Sounds like someone screwed up big-time. If the usual testing center was closed, they should have sent him to a hospital,
Better talk to HR quick.

If everything you said was true than I would take legal action. I would go to the drug test lab and have them put in writting they were closed those days and these hours. Make a copy of your husbands drug referral sheet and keep records to cover your butt. Don't wait to long on this. If your husband approaches the owner or HD and they still give problems than get an attorney.
