My former employer owed me about $4600 in Per diem and expenses. I asked him "may I have it? Yes? or No?" He said "no". So I resigned from the company with the idea that NOW he would have to pay me my back wages AND back expenses/Per diem totaling a little over $8000. he sent me a check for way short of that, about $3500. I deposited the check and had decided to feel lucky that I got what I did, only to find out that he stopped payment on the check and now I have nothing. Nor do I know why. He will not return my calls or Emails. Also, on the stub it was documented that taxes, medicare and child support were deducted, my children's mother never saw the payment. Can he do this with out any documentation of why he did not pay me what he owed me? Can he say he paid child support when they never received it? Do I have any rights or can he just push me around? I have all time sheets and per diem documented but have been paid none of it.

Looks like you need an attorney on this one. The labor board may help but may not have the power to force payment........good luck....... |

Time to call your state labor department. Yes, you have the right to get what you are owed.
Sometimes a letter to the former employer telling them that if you don't have your money within a particular time, say 15 days, you will be forced to call the state labor department will get them moving. |
