What constitutes being "hired" in Missouri?

I was offered a job and given the companies packet of paperwork to fill out. Benefits, payroll, etc. The hiring manager said he would get backs with me regarding a drug test. When he called back, he told me they had a hiring freeze now and could not hire me. I called today doing some fishing and found out they hired two other people. I think they may have called a previous employer, without my consent or application in their hands and had some off the record chat.

What is my burden of proof and what is my next step?

They don't have to hire you, and can terminate you without cause if they DO hire you. And they don't need your permission to call a previous employer. If you left the previous employer on bad terms, you might be right about what happened, but that doesn't give you a right to the job, or any legal recourse.

Find another job. They changed their mind about hiring you. It's perfectly legal.
