Without going through the whole story.
I am now being told instead of going home when my shift is over, I have to wait until the next person arrives - even if their late. No matter how late they are.
Their shift is an 12 hour shift. So in reality if no one shows up I have to be there all night. What do I do?
Can my superiors even do that? Make me stay for a shift that's not even mines?

They pay you, so they can change your job description at anytime. Get as much overtime as you can. Ask them to write up and to terminate those that can't show up on time. There should be a three strike policy in place. Than ask them to hire people that take there job as seriously as you do. It sounds like they don't really enforce the lateness policy because it doesn't really affect them (your boss). Let them know it does (your morale), and that you shouldn't have to take the fallout. Basically, ask (in a really nice way) for your boss to do his job. Do remember, they are a company and they have to cover themselves. |

Are you being paid while you are at the company? If so, then legitamitely then can ask you to stay. But if you have clocked out (12 hr shift), they cannot legally even ask you to take out the trash.
Examine your work agreement carefully - you did sign one and keep a copy??
If your employer is cheating you, leave now. Seek out your unemployment office and sign up for benefits. Talk with a counselor there about your options. And don't hesitate to turn that employer in - the truth will always come out, and it's not your problem if they're breaking the law (in any area.)
Be discreet though - now is not the time to badmouth them, etc.. Simply correct the situation and move on to the next challenge. Good luck |

If they are late, then you have a legitimate complaint against them for being late. However, if you're in a business, it is unreasonable for you to think that it's ok to just leave and abandon everybody and leave your position open.
The problem isn't with your "superiors", it is with the person who is coming in late. And it is also with your attitude. Remember, the business is hiring you because they need that job covered. If you can't be depended on to cover it until someone gets there, they can find someone who will. Any reasonable person would understand that. The person who had the job before you probably did that without being asked, so they never imagined that they'd have to insist that you act responsibly. Now, you're learning about working, and they're learning about being very specific.
Of course, you need to explain to them how impossible it would be for you to stay an entire 12-hour shift, and help them to understand the difficulties you face when the next person comes in late. Maybe they will replace that person with someone who is more responsible. But you can't really expect them to have an empty spot and nobody to get the phones. That's not good business. |

If you work more than 12 you should be compensated as overtime or doubletime. Some industries do not require this though. But workers' compensation does not cover an employee/employer after you have worked 18 hours. You should look into this. If you were to be working for twenty hours and became so exhausted that you fell and broke your arm while walking down a hallway or something simple like that, then you would be screwed and your employer could be in trouble.
If your employers have no consideration for your health, well-being, or needed time with your family, and especially sleep... then find another job. |
