I took a job that pays crap plus commision but I just found out today on my second day that nobody has seen a com. check yet, since the company started 6 months ago.
I only took this job because I was thiking I would make a ton of $$$ in com. but now I m stuck with minimun wage?or am I?
What can i do?

Do you have the commission details in writing from the company? If so, you could sue or complain to various branches of the government. If not, you don't have much to stand on. |

Depends, not on what you were told, but on what you received in writing from teh emploeyr. Did you receive a copy of a comission plan with a targeted earnings amount? Was there any guaranteed incentive for a certain period until you started earning commissions? Or was there just a vague promise that you'd make commission if you did a good job?
If you don't have a guarantee in writing, then I'm afraid you have no legal recourse. Commission is a variable form of compensation - employers are not required to pay it unless it is earned, in accordance with the terms of the commission plan specified by the employer. |

My boss promised me 20% commission on sales, no salary. Shortly after working, I realized that not only was I not making 20%, (closer t0 13%-17%) but HR was taking deductions from my commission for buying down finance paper and other cost to the company. Trying to read the payroll sheet with these deductions is a nightmare. Since I started in Oct. 2011, I still am unable to make heads or tails out of how our HR person came to the amount she has with all of my paychecks. I really believe that how they are calculating payroll is illegal. Another thing, I have a disability and the company knew this when they hired me. We had an understanding that there may be days I am unable to work. I went through a period this past month that allowed me to be very productive for the company. When the disability caused problems again, I wasn't able to work for a few days, they fired me. |
