So I started dating my boyfriend in December of 2007, we both worked together and at the time he was Department Manager and I was just a CSA. In February he received a promotion and was able to become an Assistant Store Manager, we both worked at a huge home warehouse, which I won't mention the name but it is a corporate place known all over the country. We broke things off after he got his promotion and both weren't happy about it, and so a couple of months later I applied for a transfer but for some reason it wouldn't go through. So I ended up leaving so we could be together. We have been dating ever since and things are awesome, until the other day. He was called into the HR office and confronted with a picture of him and I off of my MySpace page. Which the picture and every other picture on there was taken after I quit. Now, two months after I quit they are trying to fire him for dating me, and are using a picture that was taken after I quit against him. What my question is, is why did they wait two months to bring this up? Is this legal considering the evidence they are using against him is from after I quit. They also pulled one of our friends into the HR office and questioned him and told him if he didn't talk that he would lose his job. But yet since I quit they don't want to question me. I could clear up basically everything and let them know that he didn't do anything wrong, and that the HR manager was being nosey and didn't even get correct information. Anyway, he will find out tomorrow if he still has a job or not. But the big question is can they legally do this??

unless there is more to this then you have stated he has nothing to worry about.
at-will employees can be terminated at any time but it is not cost effective for employers to fire employees for no reason. most large employers understand that it is in their own best interest to not fire people needlessly and they do all they can to address issues and prevent that from happening. |

I suspect they will not believe that you broke it off, but are just saying that to keep him out of trouble (even I think that is what happened...sorry, but that is how it looks). The fact that you asked for a transfer and eventually left the company may help. |

Yes, they can. There is a mole somewhere who was envious, and turned him in. This was also the cause of the failure of your transfer request. He broke the rules. |
