What is wrongful termination?

the hospital I worked in said I quit my job ,I didnot I said I was going to H.R to put i n a complaint the next thing I know Iam out of there.. checks in the mail.

ModelFlyerChick is pretty close and absolutely correct on the #4 part of the answer. if your complaint was about discrimination, illegal activity or a violation of a code then you are protected. if your complaint was about other things such as mistreatment, working conditions, poor management etcetera then you would not be protected.


#3 verifiable illness is not protected, most illnesses do not fall under ADA or FMLA and if they cause absences then you can be terminated. the only time illness is protected is if they are covered by either FMLA or ADA.

Did you leave your post to go to HR? If so then that may be job abandonment. In that case you did quit by leaving your post. Check the rules you have there with the employer and what you agreed to when you started with them.

Wrongful termination is when your employer fires you based on any of the following
1) Gender, religion, race, ethnicity/ancestry, handicaps/disabilities.
2) Becoming handicapped/disabled after an accident on or off the job.
3) Verifiable illness.
4) "complaining to their employers, unions, the Occupational Safety and Health Administration (OSHA), or other government agencies about unsafe or unhealthful conditions in the workplace, environmental problems, certain public safety hazards, and certain violations of federal provisions concerning securities fraud, as well as for engaging in other related protected activities." ...see link below for further details.

If you were terminated under #4 that is wrongful termination. In that case you need to seek a lawyer.

Wrongful termination is when someone is fired because they are in a protected class.

Yours is not wrongful termination legally. They simply accepted your complaint as your resignation. Crappy, but legal.
