Well I live in new york and the place that I work at takes the money away from me for taking a break and I don't take one!To me this seems very wrong what should I do?
Additional Details
Also I work overnight 10pm-6am so instead of getting paid for 8 hours i get paid for 7 1/2 hours

They don't pay you while your on your breaks. They did the same to me, but I think it's compulsory to take a break. Something about getting fatigued at work can be dangerous. So they have to make it look like you took a break.
Just take the break. What I do is I leave early instead of taking my break. Ask your boss if you can do that. |

They are legally required to pay you for the hours you actually work. They can require you to take a lunch break, but if they let you skip it and work during that time, they have to pay you for it - that's federal law. Talk to your boss, tell him or her you haven't been taking your breaks, and see what they say. |

If your employer knows you are working on your break and not paying you they are breaking the law. Employees are to be payed for all hours worked that includes mandatory meetings and any breaks of 15 minutes or less. Contact your state hour and wage division and report your employer also you can keep this confidential so your employer will not know its you ,Im sure if they are cheating you out of money they are doing this to others. |
