What should I do when my employer violates our contract?

I signed a contract that involved a raise at my work. I have done nothing to lose this raise, and the reason for the retraction of the raise was "being tighter with money". What are my legal options if it comes down to it?

Obviously if you are wanting to seriously pursue this you will need to get a lawyer. I live in Indiana and an employer can fire you for any reason that they want. Not saying that they wouldn't have to pay unemployment, just something to keep in mind. I know if you brought lawyer paperwork to me, you would definitely be on your way out. Especially if money is tight.

Are you in the UK? I'm not a lawyer and can't give you advice that you should rely on - but you can write a letter to your employer notifying them of your concerns. If they don't respond the way you think is right, then you can go to a solicitor and, if it goes that far, go before an employment tribunal. But you MUST thoroughly exhaust your work's complaints & grievances policies and system first, if you don't, you may not (I think) have a claim. So read your contract and workplace guidelines thoroughly.

If you are under contract, make sure you understand the terms of the contract...does it say ANYWHERE in there that they have the right to retract your raise?

I can tell you right now, where my husband works, they cannot take away your raise in pay - but you can be demoted. The only money you will lose is the amount of money you received initially to get the advancement in the company. If you received $1.00 as part of the promotion...you'll lose the $1.00, but you won't lose any money that you received after that - as a raise.

Talking to an attorney would be your best bet. Most of the time, you can talk to one on the phone and it won't cost you anything (the first time).

You could sue for breach of contract if the money is significant. The money you are losing would be your "damages." It's a thin line you have to walk though, because I imagine you want to keep your job. If they fire you over this, however, then you can add wrongful termination to your causes of action in your complaint.

I'm not a lawyer but if you are seriously worried about it, get a union or private lawyer to check it out. There may be 'hidden' clauses involved. Also depends on your country's laws. I'm from Australia.
