What should we do when work is not fair?
My company has about 25 employees. Most of us are drivers/caretakes in a daycare that provides help for individuals w/ developmental disabilies. All of us love our job but we feel we are compensated enough. Why?
*We work 7am-5pm (10 hours).
*The minimum wage in California is $8.00 and we don't don't get paid for overtime.
*Most of our salaries is $75.00/day (doesn't cover what we should get paid, right?)
*Most of us don't get any breaks nor lunch breaks (we eat when clients eat)
*No one has any healthcare benefits because it costs way to much. We get around $600.00 every 2 weeks. Healthcare benefits cost us more than $100.00 every 2 weeks.
Is this fair?
If not, what should we do? Where do I go? Who do I call?

Keep in mind overtime is calculated by the week, not the day. Anything over 40 hours a week is entitled to time and a half. The daily rate and using the word "salary" is odd. However, it should be fairly easy for you to calculate your pay and overtime by your timesheet, and tell if you are being paid incorrectly.
If you are not being paid for the hours worked, and/or if you are not getting breaks/lunch (your employer is legally required to give you this) you can file a complaint with the Dept. of Labor (DOL). They will investigate and pay you back wages if they are in violation of FLSA.
Those healthcare costs actually seem pretty reasonable.

I'm sorry to say jobs aren't very fair right now. I have three jobs that I juggle my time between and I still barely make rent each month, which is very low since I live with a room mate and her son. If there isn't enough money to pay you more...what can you do? You can either take it or leave it but since you enjoy it I would take it because a lot of people hate their jobs and barely make it by. I love all three of my jobs and I know my bosses pay me what they can afford. The best thing to do when the economy is so bad like this is to be happy with less. That's not to say settle for less, but learn to be happy without a lot of money. Find new ways to pinch and save, and focus on the things you enjoy about your day. |

Well legally you are required a break for a full time shift, I know that much. Can't say about anything else but they are definately breaking a law by not giving you a break. |

contact the ca labor law, they will deal with your case, you won't have to do anything, they investigate the issue and find a solution. If you are treated unfairly and have lost wages due to your employers fault they will have them pay you. Your workplace should have a flyer posted somewhere in the building. |

The State of California should have a "Wage and Hour Division" or something similar, contact them, it sounds like you are being underpaid. The standard usually is that anything over 40 hours in a week should be 1.5 times your hourly rate. I don't know what to tell you about the health care, my wife paid $106.00 every week for the 2 of us before I got my own insurance. |

Can you talk to a lawyer who specializes in labor issues? Only he/she can tell you if this is fair or not.
Personally, it doesn't seem right, but it isn't unusual. I have often heard of this sort of thing. Many companies are cheap and try to get away with paying the minimum they can and skimp on benefits and anything extra.
In these hard economic times I think many employers will be cutting corners even more. |
