What type of lawyer do I need?
Find answers to your legal question.

What type of lawyer do I need?

I bought something from a site, and the seller agreed to refund my money because I was dissatisfied with the service. I asked for the refund in the time alloted as per the refund policy. I never had a problem contacting this seller and now they never respond to my emails and have not refunded my money. What type of lawyer do I need to sue this person to get my money back. I have every single email exchanged between myself and the seller since the very start of my purchase, including the email stating she would issue my refund. What type of lawyer do I need to get to have my money refunded as well as pay for my lawyer's fee. I am not paying a lawyer this woman can pay for putting me through all this trouble. Thank you!

Great thank you so much!

If you paid by credit card, the credit card company will investigate and refund your purchase price if they find in your favor. Since you have good documentation that a refund was offered, but never paid the credit card company should find in your favor. I have done this a few times and received a full refund. There are very short deadloines for filing a formal complaint with the credit card company.

You have a contractual dispute therefore you need an attorney that understands contract law in your state. Depending on the dollar amount, it usually is not cost effective to sue in court because the cost of your attorney will be substantial. Getting the seller to pay for your attorney fees if you prevail is quite difficult, and most likely goes back to your contractual relationship.

Contracts can be written or oral to be enforceable. If written check the small print on the back of your invoice for tems you agreed to follow.

Another option is to try your local small claims court, which will have a maximum dollar limit on claims.

Good luck.

You don't need a Lawyer.

File in your local Small Claims Court - you can do this yourself.

Good luck.
