Whats the legal length of a holiday off work and it it illegal not to have one?

I work on a ship and i work 3 weeks on, and 3 weeks off. I read in the terms and conditions that under managers discretion you can have 4 weeks off a year paid holiday. When i asked my boss he said no because it wouldn't work out.
My mum asked about it and she said she thinks its the law that you have to have a certain time off work.
Is she right and can anyone help or give advice?

Every employee in the UK is entitled to 24 days paid holiday per year, which is increasing to 28 days in October of this year. This is inclusive of bank holidays, and it is up to your employer to determine whether you are paid for bank holidays, or whether you work them and then receive time off in lieu, etc. Therefore, in many jobs (like office-based ones) where it's assumed that people will now work bank holidays and will be paid for them, their actual annual leave allowance may be less than 24 days.
All employers are within their right to determine how long you may take at one time - as an example, my own employer will not allow anyone to take more than two weeks at a time, as it's too hard for people to cover over such a long period.
If your Terms of Employment say that you can have off four weeks, then that's what you get. But you can't expect to take it all at one time. I guess your Manager assumed, from the way your question is phrased, that you were asking to have it all in one go. If you want some holiday, go back and ask for just one week and see what the response is.

I dont know how it would apply to Sea Farers Callum. When you think about it, you work 3 weeks on/3 weeks off so you already get one day off for every day you work. That is the equivalent of 6 months leave a year to start with! What more do you want? To work any less than you do now you would need to be on the dole or a politician. |

she's right..you're legally entitled to it..the managers discretion would only entail when and how much of the 4 weeks you take in one go etc etc... contact ACAS for advice or join a union |
