Ok. Here is the deal basically my dad got laid off today. A day before getting his 90 days which would have made him a permanent employee.The excuse the supervisor gave him was that his job Performance was not good. which is a bunch load of bull crap because If that was the case they would have fired him around the first month of his employment and another thing that is going on with this company. They bought out another company so all the employees are going to be transferred. The supervisor also stated that they needed to make room for the new mechanics.So they basically laid him of to make room for the transfer mechanics. The question I wanted to ask is what rights does he have?

He was hired direct from the company itself No temp agency was invovled. But he is in the union

You state that he is in the union, I would imagine that there is a 90 day probationary period before he is covered by the collective bargaining agreement.

Have him talk with his Union rep.

He was no tin the union until after the 90 day probationary period, may not have been the company but the union that did not like him. They give a chance up to the last day that is how it works as it takes some people a few months to adjust, in this case it looks like your father did not

You can always try but when hired as a temp,they do this without having to pay benefits out of there pocket,it saves money.Been there done that.My advice is don't go to a temp agency.That's what they are.
If he worked beyond 90 days he can be hired if they want him.In this lousy job market you have to be good at your job.You have to make them money.If they feel your performance isn't the best,well it's they're option what to do.I'm layed off too been a welder for 25 years.Work slowed me and another guy layed off.
