When off work ill or in hosital do i have to disclose why?

I have been off work for a week following a private matter where I have been constantly ill and have also been into hospital. Due to go back to work tomorrow but my boss is trying to make me tell her what is wrong with me. Can they do this - do I have an obligation to tell them?

I'm not certain, but I think they probably have the right to know whether it is likely to affect others, or your work in the future

Maybe you could get your doctor to write a note explaining that you were ill, that you have been required to be away from work, and explain whether you are likely to need more time off... without giving specifics.

Maybe that will make your work happy?

I know when I have needed time off for medical issues, but didn't want anyone to know, I took holiday... I know you shouldn't have to but it avoids unwanted questions!

Your employer has 2 rights. The right to know your absence was legitimate, and the right to know that your return does not endanger anyone else in the workplace. Your boss can only demand a note from your doctor stating that you were under his care for the time missed and that your condition poses no medical threats to anyone in the workplace.

Are you in the US? You don't have to tell him what your diagnosis was or the details of your problem, but he can require you to provide a note from your doctor stating that you were required to be off work for medical reasons.

And by the way, in the US, that doesn't mean the company can't still fire you for excessive absence unless you are eligible for and requested FMLA leave.

Yes.

1. If it is work-related, your employer may be liable.

2. If it is personal, your employer may demand a doctor notice for explaining the absence.

Regardless, your employment may need a clearance from the doctor saying that you are able to work.

You don't have to disclose why but you need to bring in documentation that in fact you were in the hospital ill.

I don't think so. You just need a paper from the doctor stating that you needed hospitalization.

You're going to need a proper medical note from the doctor to give to work (or you won't get paid) and that will probably say why you've been in hospital anyway.
