Why is he only getting charged with harassment when he tried to rape my girlfriend?

Guy tried to rape my girlfriend. He put his arm around her waist and hand over her mouth and was dragging her into a room at a hospital. Thank god she got away. Why is he only getting charged with harassment?

Can't he be charged with abduction or something more serious?

If she was restrained (him grabbing her and covering her mouth) and moved more than seven feet against her will (dragged into room) it is kidnapping, if it was less than seven feet and she struggled and got away, it is attempted kidnapping. If there is surveillance video of it, plus a witness, that charge should stick. They would normally add a couple of other charges as well, like assualt, assualt with intent to commit great bodily harm, and any numberr of misdemeanors just to make sure they get him on something.

Contact an abuse or victims advocate in the yellow pages, they will put the pressure on to make sure he is charged with the proper crimes.

I would push the D.A. to charge him with aggravated assault.

District Attorneys love to add more serious charges if it seems like an easy win; it looks better on their record.

Send the D.A. a letter reminding her of the evidence, and she might revise her case because of "new" evidence.

if what you describe it ALL he did, that is not rape or even attempted rape - probably not even assault
