Live in NYS and have just lost my job. The story goes (to try to make it as short as possible) my sister-in-law bought my husband and i plane tickets to come visit her for the weekend. i gave my work 2 week notice like im supposed to and asked for two of the days to be PTO and i had proof from my last paycheck i had enough for at least 2 days. the rest was in UTO. of course the week before i get my schedule, I realized they denied me!! im pregnant and have at least 3-4 doctors appts a month. When i went to talk to the manager about the issue with my schedule, she said she had to use my PTO for the two doc appts that week. i was soo furious i went home and looked in the "handbook." NOWHERE IN THAT DAMN BOOK DOES IT SAY THEY HAVE TO USE PTO FOR ANY UTO!! also, it says NOTHING about writing on the time-off slip that plane tickets have been bought(like they tried to say i should have done).. i just put "out of town." well the end of the story goes.. they never gave me the weekend off and said if i dont come to work, im fired... well im not about to just say screw it to my sister when she spent quite alot of money on those tickets. im pretty sure my work will put down as them firing me for misconduct, but because of my situation, will i still have a chance for unemployment benefits?

From what I have gathered, It doesn't look like it. BUT, you gotta remember, alot of employers (from what I read and hear in the media) are denying benefits and firing people just so they don't get their payroll taxes increased. It's all up to the Unemployment Office to make the decision on whether or not you are eligible for benefits. |

It looks like the employment law is on their side. You could call an employment attorney and see what he/she says about it. Just remember it is an employer's world right now, and they can do anything they can. You may be denied unemployment benefits since you are pregnant and can be consider not being available for work because no one will hire a pregnant woman. |

If you've been there longer then three months and stuff I wouldn't see why not. The reason their firing you is stupid and just explain that to them. |
