Work advice please ?

I have been in my job for 3 years now, a dedicated carer.I have now been told that they want me to start earlier or do night shift but i cant because i have children and i have always had the hours i do to work around family,but if i don't agree then i am out of a job.Can they do this to me?

They know i am good at my job and dedicated and the head nurse does not want to lose me, but new management does not help at all and are only interested in what money they can make and stuff the care the clients recieve. But unfortunately it does not state in my contract the time of the hours just how many i do a week.

Is an employer needs to change the terms of an employees contract they must demonstrate a business need. In reality this is rarely hard for them to do. They must then give you the option of continuing under the revised terms and conditions. If you are unable/unwilling to do so, and there is no other suitable post in the organisation, then they are able to place you on notice and eventually make you redundant (though you will be entitled to a redundancy payment).

Yes they can unless you have a contract stating the exact hours you will work. Maybe this is their way to get rid of you so they want have to pay unemployment insurance.

If you lived in France they definitely couldn't, there you work 35 hours max, companies help with child care costs, healthcare is paid for. Unfortunately, it sounds like you work in the ruthless US of A, head north for the border sister.

I think you should talk to the citizens advice bureau

They'll be able to confirm your rights, I think every company has to offer flexible hours if you have kids - but you should check with a professional.

karen are you a social care worker or an assistant? cos if you are an assistant then you aren't allowed to either work night's sleep in's or work alone, however if you have your qualifications then you will have to look closer at your contract or even the add that you applied for and see if there is anything there that states your hour's other than that if it is under new

Should they? If you've been there as long then there should be a mutual understanding. Have you talked to the hanchos about your personal needs. Because if they're aware and they're doing this coldly then it can only mean one thing .. . . time to move on to a place will respect. You may have even been black balled.

yes they can, my contract is the same.
i work a set no of hours a week, they can change what hours i work and what branch i work in.
my husband works away from home and i have a school age child so i know exactly where i you are coming from.

one of our staff members has just been moved to a different branch, she does not have a family but it is still a major inconvenience for her, she now has to leave the house earlier and get 2 buses. There is nothing she can do about it because it is still within what is deemed a " reasonable distance "

i think more and more employers are doing this :-(

Read your contract. There could be a clause in there that allows them to do this. Most companies will make doubly sure to check their legal position before telling staff about a change like that, especially so if it means the other option is that you're out of a job!

I hate that kind of like it or lump it dictation. Shows how much they value your work doesn't it?

I think you need to take your contract and problem to the Citizens Advise as they can give you a far more knowledgeable answer to your situation.
( You may find that you have either to bite the bullet or find alternative employment)

Well, in the world of competitive business, they can dictate when they need you. Both parties can terminate the work agreement for their own reasons. Scheduling conflicts and you losing your job are perfectly legal.

unfortunately yes they can it is upsetting but ur going to have to live with it im sorry for this but it will be ok youll find work it looks better on an app. if u quit but still if u explain it to them i bet they would understand that's if you don't take th offer they are giving you

You need to look at your contract and what it says in there.
Coz i lot of company's put in contracts, that they can swap your hours around.

What state are you in?
Also, it depends on whether or not you signed an "at will" agreement which means either you OR the company you work for can decide to end your employment for ANY reason.

Contact 'legal aid' for advice, (it is free legal advice in the US), if there is a place like that in the UK.

Yes they can, if it is a requirement of the job, which it seems like it is, they can ask you to do it. I know its a pain but thats the way things are.

It is not thier fault you have other commitments even though i can appreciate how frustrating this is for you.

I'm just gonna ask you to think about something here..'cause you've gotten good answers (as in: yes, they can do this to you)...
I have no children (and NOT by choice by-the-way)...I, too am a dedicated employee..and have been at my job for some years, too...
Is it more fair, in your opinion, to ask ME to change my schedule so that employees who have kids won't have to change theirs? Do people with kids automatically expect, and get, preferential treatment because they have kids? Is my inability to have children a liability for me in getting the better shift, since "parents" should get the better shift? Is that fair?
I don't think employers are being mean or uncaring to your, and others, plight...I think they are trying to be fair to everyone..kids or not..

Unfortunately, yes, they can. Most of the time, the bosses within companies are understanding about people with children, but there are other places where they don't care whether employees have children or not. . There are no laws that force them to work around a working parent's schedule because it would favor those with kids over those without who are not allowed flexible work schedules.
So, yes, they can do that. Too bad they don't want to work with you on this.

You need to read through your contract, and possibly contact a solicitor! You could go through a no win no fee one. I think this is wrong though. They cannot just sack you!

I think starting earlier would be better...than working night shifts BUT I guess if they need you in another shift and u say no they actually could laid u off

Yes, if the hours you work are not beneficial to the company right now. If the hours no longer fit, seek other employment where the hours may be more flexible. xox
