Work/job liability question?

I work an entry-level position within a major movie company, which I will name only as "ABC Video" at this time. Just to make this extra clear, I am not a keyholder, nor do I have any supervisory rights. I am at the very bottom level.

Recently my store director told me I am being held responsible for a lost bathroom key, because I handed it to a customer who needed to use the restroom but never returned it. We have had this happen to us several times before; it was never a big deal then. We also have a backup key for the restroom, but another employee left it inside, thus locking all of us out. So now we have no key to the bathroom, and my manager is holding ME financially responsible for whatever replacement key has to be made, or locks changed, etc. I was told this morning that whatever it costs to get this "problem" solved, would come straight out of my paycheck. IS THIS LEGAL?

I'd like to add on that I was told by my managers and coworkers that it was ok to give the bathroom key to customers. In fact, NO ONE ever unlocked the door for customers, because they were all always too lazy to walk back to the bathroom and unlock the door themselves.

Have you checked your employee manual? Also, has there ever been a precedence (either way) for this situation?

I think that they should give you a warning prior to requiring you to pay for a lock change. Geez, what's so important in that bathroom anyways....

No, you are not liable. Employees who accidentally lose or damage company property can not be held responsible on most cases.

After all, they are the ones telling you to handle their stuff. If they entrust you with certain responsibilities, they can't blame you when something goes wrong.

That said, it probably wouldn't be worth it to fight it, since locks aren't exactly pricey.

While you can fight it, chances are it would cost more to fight it than it would for you to pay for this. A replacement key should be a couple of dollars. A new door handle shouldn't be much over $20.

It may be valid if you read an employment handbook that indicated that you are to unlock the bathroom for the customers, and signed a verification that you had read the handbook. Even if your manager told you differently -- it would be up to you to get your employer to verify this in writing.

If there is no such handbook, it is you against your manager about this.

However, since it was not you that locked the key in the bathroom -- I don't see why you would be responsible for paying to have the door unlocked. Unless it is standard practice to use the backup key, the person who used the backup key was aware that it was the backup and should have been more responsible. They should be the one paying to have the door unlocked.

You may want to consider contacting your local law school clinic if there is one in your area and see if they can offer legal assistance. They will often be able to do this at little or no charge.
