Work refuses to pay me for federal holiday - is this legal?
Find answers to your legal question.

Work refuses to pay me for federal holiday - is this legal?

I'm an hourly full-time employee for a large corporation. I've been working there for 8 years. I was running late on Monday and punched in exactly 2 minutes late, now they are refusing to pay me for Veterans Day which was Tuesday, a paid holiday. Can they legally not pay me for the holiday? I've talked to two supervisors and human resources and they all told me I've lost my holiday pay but they don't explain why, and this seems very wrong, Can anyone provide me with any info on this? I can't afford to lose a day's pay for 2 lousy minutes!

YES.......
employers do not have to pay for any kind of time off.
employers do not have to pay an additional amount for those who do work on holidays.
employers do not have to pay for holidays federal, state religious or any other.

YES....
employers that do pay for time off or incentives for holidays may set any policy they desire in relation to that. if it is their policy to not pay for holidays if you are absent or tardy the day before or after they have every right to do so.

you have no legal "right" to any pay except for the hours you actually work and overtime if/when applicable. if you actually worked on Tuesday then you should be paid but you are owed nothing if you did not work that day and you failed to follow the policy that was required to qualify for the holiday pay.

They aren't required by law to pay you for a holiday if you didn't work that day. So it comes down to their company policy, and sounds like since you were late the day before, you don't get the holiday pay.

"federal holiday" means that it's a holiday for federal employees, not that employees other places must be paid for it.

WOW I am a veteran and have to work on Veterans day. Personally I think the only people that should have the day off with pay is veterans, we are the one's that put our lives on the line. Not all these government employees and others that get and take advantage of what we did, and gave up. As stated if you did not serve you do not deserve to get a day off with pay. All veterans should!!!!!!!!!!!

if this 'no pay' policy is listed in their company policy handbook, you are screwed. If the reason they refuse to pay you is listed in the policy handbook, you are screwed. If there is no handbook or no precedent for this, you may have a chance at getting your pay but may lose your job over it as potential trouble maker. the folks to call with this issue is your labor commissioner. Here in Minnesota, it is listed in most phone books in the state government section and a phone call should answer your questions. I have, in the past, used my labor commissioner for work related issues and have always been helped. Try them.

I think you should contact your state labor relations dept. I know some companys have policies that states if you do not work on the day before or the day after a holiday you will not get paid for it. I can't believe they refuse you pay for being 2 min. late.

Do you belong to a union? This definitely needs looking into. Yes, you can be penalized for clocking in late, but not a whole day!
