Workers Compensation?

Workers Compensation?

My wrist started hurting because of clicking of the mouse, I ask my supervisor if I can install this software so I don't need to click. She said I need to file worker comp, in order to do that, should I file it? Will it be a problem in the future for my next job?

I think she is being helpfull. She didn't give me reason, she just said thats how it works

Workers Comp laws vary from state to state, but I am not aware of any state in which a company can legally deny employment due to a previously filed workers comp claim.

That being said, your supervisor's response is incredibly short sighted. Most companies do what ever it takes to avoid workers comp claims as their premium goes up with each claim. I would suggest that if you have access to an HR department or a Sr. Manager, you may want to relay what your supervisor told you and see if they might suggest a different route.

If the pain is very uncomfortable and there is data that shows this is not uncommon, then you have a legitimate claim.
There may be (unjust) repercussions in the future, so I would only make the claim if the pain is not manageable.

I think it sounds like your supervisor wants you to be covered in case you need surgery or go to the doctor that workers comp will cover it. Also, If you do have a medical problem, the company can pay for the software and have a reason for changing it.

I don't think she is trying to harm you in any way now or with jobs in the future. She is doing her job to ensure help for you and your pain. You will also go to the doctor and not have to pay for any part of it. You will pay for nothing if it is a comp claim.

I am sure the company would rather have you get what you need to do your job than to have you miss work with an injury.


EDIT NOTE: WHY does everyone think the employer is out to get you if you file a workers comp claim? That is just not true. If you need to use it, you need to use it. That is the bottom line.

Off the record, maybe. Companies are not falling over themselves to hire people with prior workers comp cases, although its not correct to do so. Filing a workers comp case also takes time (and doctor visits) & costs you as a taxpayer $. Better to try & work with your supervisor or her supervisor ( or personnel if you have one) to get this software. Perhaps you could do some research on the cost of the software and how it would make things more efficient etc. There is also the probability that you could "loose" the case! Then what?!

wear a wrist band, Filling a comp case will follow you for the rest of your life. If you do file a claim make sure you file a major medical claim. Believe it are not it will look better on your resume then a small claim.

I guess it could be, but if your supervisor told you to do it, you might should at least think about it. What are your supervisor's reasons, do you think he/she wants to get rid of you or was he/she just trying to be helpful. I would weigh it out and make your decision from there.
