If your hurt at work, but it was during a 15 min break. Are you covered under workmans Comp?

if you in the work property then yes but if you were off their property then no. also were you punched in or do you punch out for breaks

It is a definate yes if the employee handbook states that you may not leave the property on a 15 minute break. It makes a difference

Depends entirely upon your State's Workers' Compensation Laws.

Some states state that you must be performing work, not on break or coming in the building.

and breaks are not mandatory by Federal Law, some by state law.

Yes, because most 15 minute breaks are paid breaks.

You are also covered by workman's comp even if you clock out and get hurt walking into and out of the building.

I find it hard to believe how someone could get hurt during a break.

Yes, as long as you were on the employers premisis, and on the clock during your break. (If you clocked out then left the worksite to do something non-work related then you may not be covered)

I would say so, but Workman's Comp. insurance companies are famous for screwing the injured worker. A lot depends on what kind of injury and what you were doing when it happened.

YES, BECAUSE THEY ARE REQUIREDTO GIVE YOU BREAKS WHILE ON THE CLOCK IF YOU WERE SCHEDULED A CERTAIN # OF HOURS
