Would I be expelled/in legal trouble for this?
I was walking to my school (charter school) and some random kid out of nowhere makes a derogatory remark towards me for no reason and I respond by saying "what the hell? Ill beat the **** out of you".

A teacher was there and this is my first offense at the school and I am not on probation. They suspended me for 10 days and I have a "Long term hearing", do you think this would escalate into the court system? And do you think the chance of me being expelled is likely?

I did not see any police and I don't think they were called.

No, not at all. But, depending on you're school and how good of a student you are, you may be expelled, though unlikely.

You used foul language and threatened bodily harm to another student.

You have to learn to maintain better control over yourself. When you get out of high school, hopefully go to college and get a real job, you would have been immediately fired for such a comment.

If you cannot control yourself, then you need to get counseling for anger management.

"Don't talk to me like that", "Whatever!", "Leave me alone, I don't want to talk to you", are all acceptable responses.

If you cannot communite without threatening someone and cursing, then that is the sign of another problem.

No, there is little chance of it becoming a legal matter. For it to constitute assault, you would need to create apprehension in the victim of actual bodily harm, and it doesn't appear that way. Other than you getting in trouble with the school, I would say you'll be fine.

If you're really concerned, speak with a lawyer.

highly doubt this will turn into a legal problem..the disciplinary action is just your schools policy of dealing with"violence"..do you hav a schools handbook?..read it and see what the procedures are..

secondly you didn't actually beat the **** out of anyone!so there is no bodily damage or assult that could have legal implications with law enforcement.

and if a teacher was there..didn't he/she see what exactly happened?..if this kid verbally attacked you i only hope that he/she also recieved a suspension! which would be fair since but right you didn't instigate the matter..just tell the truth at your hearing,be honest,apologize and follow whatever you need to do to be in good moral standing with your schoool again..

and take it easy..don't let little things get under your skin ..you're only a kid..as a grown up you will have to deal wit such things on a daily basis with much more to loose..so just keep a cool head and be the bigger person.
