Would like all your opinions on this matter!?

I was fired on May 17, 2009. The reason for this was as follows: A note in my handwritting was found beside a computer at the store where I worked. Another employee found it on my day off. It was an address to an adult website and my personal ID number. Must have fallen out of my pocket. The employee who found it proceeded to open it and spread the contents to the rest of the employees. Made me a laughing stock and I got fired for being on an unauthorized website. The thing is, I never opened the site.I opened my e-mail after the store was closed, saw the site and wrote it down to look at it later at home.It was my day off and I wasn't even able to defend myself. I worked for this company for 25 yrs.I was the only HR person they had.There is no such rule (unauthorized websites) written and we all had permission to view our e-mail.I am a widow of 4 yrs, a mountain of bills and no savings. I am now losing everything!I am 54 with no job and no education Legal case or not? State of MO.

If they fired you for this, then was there something else they wanted you gone for? I highly doubt that if you had been there for 25 years, that they would fire you for just this. Maybe they thought that you were not doing your job. Maybe you pissed off the wrong person? If you've got 25 years under your belt, I am not thinking that you will have a hard time finding another job. Try to find out the real reason they fired you. If this is indeed the real reason then take your services somewhere where they will be appreciated. Good luck dear.

As an HR professional I would imagine you would have known to open your mail once you got home regardless if this was allowed. What I find ironic is you were fired for opening an unauthorized site? To make such an allegation I am assuming they have proof of this? Where is the copy of the history showing you in fact did go into this website on company property. If you never utilized company property to EVER enter any illegal websites then I would certainly secure an employment laywer. You may have grounds for wrongful termination. However, regardless if there was no policy stating employee's are not allowed to enter unauthorized websites especially the one you speak of I highly doubt this activity would be protected under any employment laws if in fact you ever did utilize company property to enter these sites during work hours or none work hours.

I doubt there is much you can do. They dismissed you for using company equipment in a manner they did not approve (opening your email and recording a website address they did not approve of.)

Obviously, you have some ability with the computer. You can start your own business offering email monitoring and sending services for individuals and companies who do not have the time or inclination to do this for themselves. It doesn't cost much to do this, but you would have to do a lot of door knocking to get started.

If you run your own business, you make your own rules and won't have to put up with this kind of schtuff.

Sounds pretty shakey- BUT- as Im sure you are aware, your employment would hvae been at-will. So they probably had every right to get rid of you, regardless of if it actually happened or not. Good luck in finding something new, quickly.

Honestly,
If you were their only HR person then you should alread know the answer. You wold know what your corporate rules are in accordance to internet usage. Whether you signed that poilcy or not? It is a EDD decision now if they rule in your favor then you could look into suing them for firing you. Real iffy situation. They will check the computer and see whether you have visited the site or not, thats the easy side for them. Good luck and keep to the safe sites while at work.

if there is no such rule then i say take it to court. that was yor job and you worked there for a really long time. besides you didnt even look at the site.

you should have told them to check your internet history to prove you didn't go there.
