Would this be considered workman's comp?

Would this be considered workman's comp?

The other day at work they were testing our fire alarm system and the lights were flashing on and off for an hour. Everyone was talking about how they felt dizzy and had headaches and felt faint from the lights. I already am predisposed to passing out, and I did end up passing out and was taken to the hospital because I was fine before the lights and hadn't passed out for a very long time. Today in the mail I got something about the incident being considered workman's comp. I'm going to call my lawyer on Monday, but I was just wondering if anyone had any thoughts on if it is or not?

I was only contacting my lawyer to see if I should have my health insurance cover it or if it has to be worker's comp, because I don't feel that it was

I'm assuming that if you were taken to the hospital that an official "incident report" was filed. If that's the case then that would be step 1. To make a "workers" comp claim (it's workers comp now, not workman's anymore, PC and all) you just need to file as your employer should pay for the ambulance ride, emergency room bills, etc.. as the incident was due to the problems at work. They only reason they may possibly fight it is due to (as you state) your "preexisting condition". However, for a one time incident, I don't think your employer will fight you. Long term disability claim would probably be another story.

I find it interesting that you are contacting a lawyer over this minor incident. It is likely your employer will pick up the cost of the hospital but passing out doesn't sound like you have much in the way of a disability claim. Don't start spending those big settlement bucks yet.

If anything happens to you on work premises then they are reliable for you and yes you can look into getting workman's comp, but if you didn't get hurt I would leave it a lone. Workman's comp can be a nasty thing to get into with your job.
